1. About this service
Resident Authority is a digital mandate signing service operated by Britannia Crescent Residents Co‑operative (“we”, “us”, “our”), registered in England and Wales. The service enables shareholders at Britannia Crescent and Comet Close to complete and submit shareholder authorities and mandate documents electronically.
By accessing or using this service you agree to these Terms & Conditions. If you do not agree, please do not use the service.
2. Eligibility
The service is available solely to current shareholders and authorised residents at Britannia Crescent and Comet Close. You must hold a valid property code, issued on a printed code card, to begin a signing session. Use of another person’s code without authorisation is strictly prohibited.
3. Electronic signatures
Signatures captured through this service constitute valid electronic signatures under the Electronic Communications Act 2000 and the Electronic Signatures Regulations 2002 (SI 2002/318). By drawing or typing your signature and confirming your details, you agree that:
- your electronic signature is legally equivalent to a handwritten signature on the relevant document;
- you have read and understood the mandate or authority presented to you;
- you are the named shareholder or a duly authorised signatory acting on their behalf.
4. Accuracy of information
You are responsible for ensuring all information you submit, including your name, address details, and co-signatory information where applicable, is accurate and complete. Submitting false or misleading information may render a signed mandate invalid and could constitute fraud.
5. Acceptable use
You agree not to:
- attempt to circumvent the property code authentication system;
- submit a mandate on behalf of another person without their explicit written authorisation;
- use automated tools, bots, or scripts to interact with the service;
- attempt to access or interfere with records belonging to other shareholders;
- use the service for any unlawful purpose.
6. Mandate records and confirmation
On successful submission, a signed authority PDF is generated and a confirmation email is sent to the address you provide. You should retain this confirmation. We retain a copy of all completed mandates for our administrative and legal records; please refer to our Privacy Policy for full details.
Once submitted, a mandate cannot be edited through the service. If you believe you have made an error, please contact us via the Support page.
7. Service availability
We aim to keep the service available but make no guarantee of uninterrupted access. We may suspend or withdraw the service at any time for maintenance, security, or operational reasons. We will not be liable for any loss arising from an inability to access the service during such periods.
8. Limitation of liability
To the fullest extent permitted by law, we exclude all warranties, representations, and conditions in connection with the service. We shall not be liable for any indirect, consequential, or special losses arising from your use of the service, including loss of data or loss of income. Nothing in these terms limits our liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded under English law.
9. Changes to these terms
We may update these Terms & Conditions from time to time. The date at the top of this page indicates when they were last revised. Continued use of the service after a change constitutes acceptance of the updated terms.
10. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
